KCI’s invoice shall be paid within 28 days of issue, unless specifically agreed prior to the booking, in writing.
Right to reproduce images derived from bookings only become effective when the invoice for that booking is paid in full. Any permission for prior use will be automatically revoked if payment is not made in full.
KCI may exercise its statutory right to interest under the Late Payment Of Commercial Debts (Interest) Act 1998, if any invoice falls outside its agreed payment terms. The Client's right to reproduce a picture arises only when KCI’s invoice relating to the grant of such right is fully paid (including interest charges levied on late payment of the invoice or invoices).
Ken Crook Imaging retains the copyright, as specified in the CPDA 1988, to all works created by Ken Crook Imaging for the period stated within the act. Rights of reproduction purchased are for the purposes and periods as specified within the negotiation of each assignment.
Reproduction rights granted are personal to the Client and may not be assigned, nor may any picture submitted to the Client be loaned or transferred to third parties for the promotion or use of the third parties or their businesses.
KCI asserts both its moral right to be identified as the author of its work and the right to a credit is asserted in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988. All pictures wherever used must be credited as follows:- © Ken Crook Imaging
Failure to credit copyright to Ken Crook Imaging shall incur a penalty fee of 100% of the assignment.
All digital images supplied by KCI contain a metadata file within the digital image, this data identifies the author and copyright holder and must not be removed or altered at any time. Removal of the metadata file is prohibited by law. http://www.legislation.gov.uk/uksi/2003/2498/regulation/25/made
